Section 41
Crime and Punishment
(1) A person shall be deemed to have committed an offense under this Act if he commits the following acts:-
(a) Destroying, damaging, erasing, manipulating, rendering unusable, giving to unauthorized persons, creating false information, stealing or destroying any details or information contained in records and data stores related to national identity cards and registration. To cause damage to physical infrastructure, electronic data or data systems including data storage, computer system or network structure,
(b) stealing, damaging, destroying or unauthorized alteration of any computer program, computer software, computer system or network used for data storage, communication network or identity card printing, (c) Submitting false information or preparing false or false documents for obtaining identity card and personal incident registration certificate,
(d) Duplicating or forging identity cards and personal event registration certificates,
(e) Violating the confidentiality of information contained in the database, identity card and related records, except in accordance with this Act or prevailing laws,
(f) Issuing or causing to be issued identity card and personal incident registration certificate despite the clear grounds that it is a false statement,
(g) To remove obstacles in the collection, processing or storage of information related to national identity card and registration or service delivery or related activities,
(h) Voluntarily adding, deleting, correcting or correcting the details in the identity card and personal event registration certificate,
(j) If an identity card as per Section 47 is obtained by giving false details or if the details of such identity card are voluntarily added, altered or corrected,
(h) commit any other act contrary to this Act or the rules made under this Act.
(2) A person who commits an offense under Clause (a) or (b) of sub-section (1) shall be liable to a penalty of five years for the damage caused and the fine as per the fine.Imprisonment for up to ten years and fine ranging from Rs.5 lakh to Rs.10 lakh.
(3) A person who commits an offense under clause (c), (e) or (f) of sub-section (1) shall be imprisoned for a term of two years to five years and shall be fined from twenty thousand rupees to fifty thousand rupees.
(4) A person who commits an offense under clause (d) of sub-section (1) shall be punished with an additional twenty-five percent of the punishment for forgery or forgery in accordance with the prevailing law.
(5) A person who commits an offense under clause (g), (h), (j) or (h) of sub-section (1) shall be imprisoned for a term of three months to six months and shall be fined from ten thousand rupees to fifty thousand rupees.
(6) A person who assists in committing an offense under sub-section (1) or who acts under the influence of any other person shall be punished with half of the punishment imposed on the principal offender.
